1. Agreement to Terms

By installing and using MODA AI ("the App"), you agree to these Terms of Service. If you disagree with any part of these terms, you may not use our App.

2. Description of Service

MODA AI is a Shopify application that generates professional fashion catalog images using artificial intelligence. The service transforms garment photos into styled catalog shots with various poses, angles, and settings.

2.1 Service Features

• AI-powered catalog image generation
• Multiple shot types and pose variations
• Credit-based pricing system
• Bulk download capabilities
• Real-time processing status tracking

3. Credit System and Billing

3.1 Credit Packages

• Trial: 2 free credits for new merchants
• Individual: 1 credit = $1.25
• Small Pack: 10 credits = $10.00
• Medium Pack: 22 credits = $20.00 (10% bonus)
• Large Pack: 60 credits = $50.00 (20% bonus)

3.2 Usage Policy

• 1 credit = 1 catalog generation batch (up to 10 images)
• Credits are non-refundable once processing begins
• Trial credits expire upon app uninstallation
• Purchased credits do not expire

4. Acceptable Use

4.1 Permitted Uses

• Generating catalog images for legitimate business purposes
• Creating marketing materials for your Shopify store
• Professional product photography enhancement

4.2 Prohibited Uses

• Nudity and Pornography: Any attempt to create, generate, or process images containing nudity, sexual content, or pornographic material is strictly prohibited. This includes but is not limited to revealing garments, suggestive poses, or any content of a sexual nature. Violation will result in immediate processing failure with no credit refund.
• Uploading inappropriate, offensive, or illegal content
• Generating images for adult or explicit content
• Using copyrighted images without permission
• Attempting to reverse-engineer our AI models
• Exceeding reasonable usage limits or system abuse

5. Intellectual Property

5.1 Your Content

• You retain ownership of uploaded garment images
• You grant us license to process images for service provision
• You represent that you have rights to uploaded content

5.2 Generated Images

• You own the generated catalog images
• We retain no rights to generated content
• Images are automatically deleted after 6 months

5.3 Our Technology

• Our AI models and algorithms remain our property
• You may not attempt to copy or reverse-engineer our technology

6. Service Availability

6.1 Uptime

• We aim for 99.5% service availability
• Scheduled maintenance will be announced in advance
• Emergency maintenance may occur without notice

6.2 Processing Limits

• Maximum 10 images per catalog generation
• Maximum 10MB per uploaded image
• Processing timeout after 10 minutes per batch

7. Disclaimers and Limitations

7.1 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THE ACCURACY, QUALITY, OR SUITABILITY OF GENERATED IMAGES.

7.2 Limitation of Liability

OUR LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

8. Content Policy

8.1 Content Safety

• AI models include built-in content safety filters
• Inappropriate content will be automatically blocked
• Repeated violations may result in account suspension

8.2 Quality Standards

• Input images should be clear and well-lit
• Garments should be properly displayed
• Background should be clean and uncluttered

9. Refund Policy

9.1 Credit Refunds

• Unused credits may be refunded within 30 days of purchase
• No refunds for credits used in processing
• Technical failures will result in credit restoration

9.2 Billing Disputes

• Contact support within 30 days for billing issues
• Shopify handles all payment processing and disputes

10. Account Termination

10.1 Termination by You

• Uninstall the app from your Shopify admin
• All data will be deleted within 48 hours
• Unused credits are forfeited

10.2 Termination by Us

• We may suspend accounts for terms violations
• 30-day notice for non-payment issues
• Immediate termination for severe violations

11. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy for information about how we collect, use, and protect your data.

12. Updates to Terms

We may modify these terms at any time. Significant changes will be communicated through the app or via email. Continued use after changes constitutes acceptance.

13. Governing Law

These terms are governed by the laws of India. Any disputes will be resolved through binding arbitration in Mumbai, Maharashtra.
